1. Acceptance of Terms

By accessing or using HabanoFinder ("the Service"), available at habanofinder.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

2. Description of Service

HabanoFinder is a search engine and price comparison tool for Cuban cigars. We aggregate publicly available product listing information from third-party retailer websites and present it in a unified, searchable format.

HabanoFinder does not sell, distribute, ship, or handle cigars or any tobacco products. We are not a retailer, wholesaler, or distributor. All purchases are made directly between you and the third-party retailer. We have no control over and accept no responsibility for the products, pricing, availability, shipping, customs, delivery, authenticity, or quality offered by any third-party retailer.

The Service includes:

  • Searching and browsing Cuban cigar listings aggregated from third-party retailers
  • Price comparison across multiple retailers, including per-unit cost calculations
  • Historical price tracking and trend data
  • In-stock alerts and price drop notifications
  • Community reviews of third-party retailer experiences
  • Newsletter with curated deals and information

3. Eligibility and Age Requirement

You must be of legal smoking and tobacco purchasing age in your jurisdiction to use HabanoFinder. In most US states, this is 21 years of age. By using the Service, you represent and warrant that you meet the minimum age requirement in your jurisdiction.

You are solely responsible for understanding and complying with all applicable local, state, national, and international laws regarding the purchase, importation, and possession of tobacco products, including Cuban cigars. Laws regarding Cuban cigars vary by jurisdiction and may change. HabanoFinder makes no representations about the legality of purchasing Cuban cigars in your jurisdiction.

4. User Accounts

Certain features of the Service require a registered account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for any reason including violation of these Terms.

5. Free and Premium Tiers

HabanoFinder offers both free and premium subscription tiers. Free tier users have access to core search, comparison, and browsing features. Premium subscribers receive additional features including instant in-stock alerts, full historical pricing data, price drop alerts, and deal scoring.

Premium subscription fees are billed according to the plan selected at the time of purchase. Prices are subject to change with reasonable notice. Refund policies will be communicated at the time of subscription.

6. Pricing Data and Accuracy

Prices displayed on HabanoFinder are collected from third-party retailer websites through automated means. While we strive to keep pricing data current (updated approximately every 15 minutes), we cannot guarantee that prices shown on HabanoFinder are accurate, current, or complete. Prices on retailer websites may change at any time without notice to us.

Before making any purchase, you should always verify the current price, availability, and terms directly on the retailer's website. HabanoFinder is not responsible for pricing discrepancies between our displayed data and actual retailer prices.

7. User-Generated Content

Users may submit reviews and ratings of third-party retailers. By submitting content, you grant HabanoFinder a non-exclusive, royalty-free, worldwide, perpetual license to use, display, modify, and distribute your content in connection with the Service.

You agree that your submitted content will not:

  • Be false, misleading, defamatory, or fraudulent
  • Infringe on any third-party intellectual property rights
  • Contain illegal, abusive, or objectionable material
  • Include personal information about others without their consent
  • Contain spam, advertising, or promotional content

We reserve the right to remove, edit, or refuse to publish any user-generated content at our sole discretion, without notice or explanation.

8. Third-Party Retailers and Links

HabanoFinder provides links to third-party retailer websites for your convenience. We are not affiliated with, endorsed by, or partnered with any of the retailers listed on our platform unless explicitly stated otherwise. We do not control and are not responsible for the content, products, services, privacy practices, or policies of any third-party website.

Any transaction you enter into with a third-party retailer is solely between you and that retailer. HabanoFinder shall not be liable for any loss, damage, or dispute arising from your dealings with any third-party retailer, including but not limited to issues related to product quality, authenticity, shipping, customs, delivery, returns, or refunds.

9. Intellectual Property

All content on HabanoFinder, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of HabanoFinder or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

Product names, brand names, and logos of Cuban cigar manufacturers and third-party retailers are the trademarks of their respective owners. Their use on HabanoFinder is for identification and comparison purposes only and does not imply endorsement or affiliation.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means to access or scrape the Service without our prior written consent
  • Impersonate any person or entity or misrepresent your affiliation
  • Circumvent, disable, or interfere with security features of the Service
  • Use the Service to collect personal information about other users

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any information provided through the Service, including pricing data, product availability, or retailer information.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, AUTHENTICITY, OR QUALITY OF PRODUCTS OFFERED BY THIRD-PARTY RETAILERS. WE DO NOT GUARANTEE THAT ANY PRODUCT LISTED ON HABANOFINDER IS GENUINE, AUTHENTIC, OR AS DESCRIBED BY THE RETAILER.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HABANOFINDER AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO HABANOFINDER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless HabanoFinder and its owners, operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in the State of Delaware.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

16. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
